Limitation on Liability XNET WiFi, its subsidiaries, affiliates, licensors, service providers, content providers, employees, agents, officers, and directors will not be liable for any incidental, direct, indirect, punitive, actual, consequential, special, exemplary, or other damages, including loss of revenue or income, pain and suffering, emotional distress, or similar damages, even if XNET WiFi has been advised of the possibility of such damages. In no event will the collective liability of XNET WiFi and its subsidiaries, affiliates, licensors, service providers, content providers, employees, agents, officers, and directors exceed the greater of $100 or the amount you have paid to XNET WiFi for the applicable content, product, or service out of which liability arose.

Indemnity You will indemnify and hold XNET WiFi, its subsidiaries, affiliates, licensors, content providers, service providers, employees, agents, officers, directors, and contractors harmless from any breach of these Terms of Use by you, including any use of content other than as expressly authorized. You agree to indemnify any and all resulting loss, damages, judgments, awards, costs, expenses, and attorney’s fees of the indemnified parties in connection therewith. You will also indemnify and hold the indemnified parties harmless from any claims brought by third parties arising out of your use of the information accessed from this site.

9. Trademarks Trademarks, service marks, and logos appearing in this site are the property of XNET WiFi or the party that provided them to XNET WiFi. XNET WiFi and any party that provided trademarks, service marks, and logos to XNET WiFi retain all rights with respect to any of their respective trademarks, service marks, and logos appearing in this site.

10. Privacy XNET WiFi will treat any personal information that you submit through this site in accordance with its Privacy Policy.

Service Terms & Conditions

  1. Service Description:

    • Our Service provides mobile internet devices along with data plans for internet connectivity on-the-go. The Service is subject to these Terms and any applicable policies or guidelines provided by us.

  2. Cancellation and Refund Policy:

    • Cancellation Period: Customers have a 14-day cancellation period from the date of initial order to return the device and receive a refund on both the device and Service.
    • Refund Eligibility: To qualify for a refund, the device must be returned within the 14-day cancellation period in its original condition with all accessories included. Refunds will be issued for the cost of the device and any prepaid service fees.
    • Customer Responsibility: Customers are responsible for the cost of return shipping when sending back the device. The device must be returned in good condition to qualify for a refund.
    • Non-Refundable Items: Shipping charges incurred at the time of purchase. Activation fees associated with setting up the Service.
    • Refund Process: Upon receipt and verification of the returned device, refunds will be processed promptly to the original payment method.
    • Late Cancellation: Cancellation requests received after the 14-day period may not be eligible for a refund.

  3. Usage:

    • Acceptable Use: The Service is for personal use and may not be used for illegal purposes or in a manner that violates any laws or regulations.
    • Data Usage: Data usage is subject to the terms specified in the selected data plan.
      • Fair Use: We reserve the right to monitor data usage and to take appropriate action if we determine that your usage exceeds what we deem as fair and reasonable. If your data usage significantly exceeds the average usage of our customers, we may reduce your data speed, restrict your data usage, suspend, or terminate your Service. You will be notified if such actions are to be taken and provided with options to avoid service disruption.

  4. Equipment:

    • Device Ownership: The equipment provided by XNET WiFi (“Equipment”) remains the property of XNET WiFi until it is paid for in full.
      • Full Payment Option: If a customer purchases the Equipment for the full cost at the time of the initial order, then ownership transfers to the customer upon receipt. The customer may keep the Equipment even if they cancel the Service within the 14-day cancellation period, in which case they have the option to ship it back for a full refund.
      • Split-Payment Option: If a customer elects the “Split Payment” option, they are required to pay for half of the Equipment cost at the initial order and the remaining half 30 days later. Until the full payment is made, XNET WiFi retains ownership of the Equipment and reserves the right to request the return of the Equipment at any time and for any reason.
        • Device Split-Payment Agreement: By selecting the Split Payment method for the device on the Company’s website, the customer acknowledges that they have read, understood, and agreed to the terms and conditions outlined in the Device Split-Payment Agreement.
        • Cancellation Within 14 Days: If a customer cancels the Service within the 14-day cancellation period, they have the option to return the Equipment for a full refund.
        • Return of Equipment: In case of cancellation or termination of Service, the customer must return the Equipment to XNET WiFi in good condition, unless they have fully paid for the Equipment and ownership has been transferred.

  5. Customer Support:

    • For assistance or inquiries regarding the Service, please contact our customer support team.

  6. Modifications:

    • We reserve the right to modify or update these Terms at any time. Changes will be effective upon posting to our website or notifying customers directly.

  7. Governing Law:

    • These Terms are governed by the laws of the State of Idaho, United States.
 

By using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
